MSMEs and Intellectual Property Rights 

Intellectual Property Rights or IPR has become a common buzzword in the business world today. India as a signatory of WTO is bound to implement standard IPR protection laws. In India the main aspects related to IPR are Copyright, Trade Mark, Patent, Industrial Design and Geographical Indication.

Awareness of IPR benefits to the MSMEs is mainly on two fronts. Firstly, how they can protect their creations i.e. to protect their own intellectual property rights and secondly, how they can avoid violating intellectual property rights of others. Furthermore, this increased awareness will encourage MSMEs to make better use of IPR system and make it an integral part of their business strategy.

While on one hand this section intends to help MSMEs to understand IPR from business perspective on the other it tries to expose the IPR needs of the MSMEs to policy makers. This section provides links to all different IPR related Acts of India viz. The Copyright Act, 1957, Trademarks Act 1999, The Design Act, 2000, The Patent Act 1970, Semiconductor Act and The Geographical Indications of Goods (Registrations and Protection) Act, 1999.

Frequently Asked Questions (FAQs) are answered on different IPR aspects. An effort is made to give a brief account of IPR status in India. Other resources which are available include list of IPR firms in India along with details of different patent offices. How to file an application for copyrights or industrial design or Geographical Indications are also given.
